Towards the end of their term in government, the Conservatives enacted new laws pertaining to the sex trade. Based on the Nordic model, these laws legalize selling but criminalize purchasing.
The legislation passed to update the laws previously overturned by Canada’s Supreme Court is documented in the Protection of Communities and Exploited Persons Act.
Here are more details on how these changes were finalized into law, and which sections of the criminal code they impaced:
- Section 150 of the Criminal Code: PART V – Sexual Offences, Public Morals and Disorderly Conduct
- Criminal code section 197: PART VII – Disorderly Houses, Gaming and Betting
- Section 286.1 : Commodification of Sexual Activity
These laws were crafted hastily and likely will not withstand a Supreme Court challenge.
